Trademark Co-Existence Agreement – Allows two parties to use similar marks under agreed conditions. Download the template and get advice, filling guidance now!
Resolving trademark opposition, cancellation, or infringement disputes and permitting two distinct entities to use or register similar or identical trademarks in Vietnam requires precise legal structuring through a Trademark Co-Existence Agreement. Under the Vietnamese Intellectual Property Law and Civil Code, brand owners frequently encounter conflicting trademark applications or overlapping market sectors during IP VietNam prosecution. Establishing a formal co-existence agreement enables businesses to define clear territorial boundaries, goods/services differentiation, marketing restrictions, and consumer confusion safeguards while avoiding costly administrative litigation or court battles.
